TERMS OF USE
Please read these Terms of Use carefully before using this site. By using this site, you signify your agreement with these Terms of Use. If you do not agree with any of the below Terms of Use, do not use this site.
Stan Lee Media, Inc. (hereinafter referred to as "Stan Lee Media") reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms of Use at any time and you agree to be bound by such modifications, alterations or updates.
TRADEMARKS, COPYRIGHTS AND RESTRICTIONS
This site is controlled and operated by Stan Lee Media. All material on this site, including, but not limited to images, illustrations, audio clips, and video clips, is protected by common law and registered trademarks, and copyrights which are owned and controlled by Stan Lee Media or by other parties that have licensed their material to Stan Lee Media.
Material from stanleemedia.com, stanlee.net, or any web site owned, operated, licensed or controlled by Stan Lee Media may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modifications of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights.
For purposes of this Terms of Use Agreement, the use of any such material on any other web site or networked computer environment is prohibited.
In the event you download software from Stan Lee Media web sites, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by Stan Lee Media.
Stan Lee Media does not transfer title to the Software to you. You own the medium on which the Software is recorded, but Stan Lee Media retains full and complete title to the Software, and all intellectual property rights therein.
You may not redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce the Software in any form.
PRIVACY
Stan Lee Media is very respectful about the privacy concerns of the visitors to its sites on the Internet. As a general policy, no personal information is automatically collected from visitors to its sites. However, certain non-personal information of visitors is recorded by the standard operation of Stan Lee Media's Internet servers.
This information is primarily used to provide an enhanced online experience for the visitor. E-mail addresses and other personal identifiable data about visitors to this site are known to Stan Lee Media only when voluntarily submitted.
Personal identifiable information that may be collected in connection with visitors voluntarily filling out contest entry forms or subscribing to newsletters is retained by Stan Lee Media. This data in an aggregate form may be provided to other parties for marketing, advertising or other uses.
We sometimes also use e-mail addresses and other personal identifiable information to contact visitors who communicate with us. For example, we direct e-mail to visitors who provide us with their e-mail addresses for specific purposes such as receiving our e-mail newsletters or being notified if they have won one of our contests.
Each e-mail newsletter always contains instruction on how to discontinue receipt of the newsletter.
Users should be aware that when they voluntarily disclose personal information (e.g., user name, e-mail address, phone number) on the bulletin boards or in the chat areas, that information can be collected and used by others and may result in unsolicited messages from other people.
To the extent that any of our sites accessible through Stan Lee Media has additional practices, these practices will be explained at that site.
POLICIES FOR KIDS (INDIVIDUALS UNDER 13 YEARS OF AGE)
Stan Lee Media complies with the Children's Online Privacy Protection Act. All Stan Lee Media sites display a clear and prominent link to this privacy policy.
Personal information collected through registration includes the first and last name of the user, the user's e-mail address, the user's gender, date of birth, zip code, country of residence, chosen online nickname ("username"), and chosen online password, user's parent's e-mail address if user is under 13 years of age.
Stan Lee Media does not require a user under 13 years of age to disclose more information than is reasonably necessary to participate in an activity as a condition of participation.
All registrants receive an e-mail confirming their Registration. In addition, when a user under 13 years of age registers, he/she is required to provide the e-mail address of his/her parent or guardian and that parent or guardian receives an e-mail alerting them to that Registration.
Registered users under 13 years of age may participate in such activities upon Registration, unless their parent or guardian asks that their registration be invalidated. The e-mail sent to the parent or guardian informs him/her of what information has been collected, and provides him/her with the opportunity to remove the registration of his/her child from the site.
A new e-mail will be sent to the parent or guardian if changes are made to the kinds of information that is collected from the user under 13 years of age; if changes are made to how the information collected from the user under 13 years of age is used; and/or if the information collected from the user under 13 years of age is offered to new and different third parties.
Parents or guardians may review their child's personal information, have their child's personal information deleted at any time, and refuse to permit further collection or use of their child's information by following the directions outlined in the confirmatory email, or contacting us at mailto:customerservice@stanleemedia.com.
Although users under 13 years of age may be allowed to participate in some contests and promotions, if such a user wins, notification and prizes are sent to the parent or guardian identified in the initial registration process. Publication of names, ages, or images for contest winners under 13 years of age require parental or guardian consent.
If Stan Lee Media discovers that a user about who it has collected information from has misrepresented his or her age and is in fact under age 13, or that a user under 13 years of age has disclosed personal information on its bulletin boards or in any other public forum on its site, Stan Lee Media will comply with the Federal Trade Commission regulations under the Children's Online Privacy Protection Act of 1998.
USE OF COOKIES
Cookies are pieces of information that a website transfers to an individual's computer hard drive for record keeping purposes. Cookies make using our Sites easier by, among other things, saving your passwords and preferences for you. As an example, we use cookies to keep track of your shopping cart when you visit our online store, and help identify you when you return to the store.
These cookies are restricted for use only on our Sites, and do not transfer any personal information to any other party. E-MAIL AND POSTINGS RECEIVED
Do not post any threatening or libelous e-mails or material on this site that would be considered a violation of any law.
Stan Lee Media will fully cooperate with any law enforcement authorities or court order requesting or directing Stan Lee Media to disclose the identity of anyone posting any such e-mails or materials.
SUBMISSIONS
Stan Lee Media is pleased to hear from its loyal fans and welcomes your comments regarding Stan Lee Media products, including Stan Lee Media's online services. Unfortunately, Stan Lee Media's company policy does not allow us to accept or consider creative ideas, creative suggestions, ideas, notes, drawings, concepts, suggestions, other information, or materials, other than those it has specifically requested.
Any notes, message/billboard postings, ideas, suggestions, concepts or other material submitted will become the property of Stan Lee Media throughout the universe and Stan Lee Media shall be entitled to use the material for any type of use forever including in any media whether now known or hereafter devised.
Stan Lee Media is not responsible for any material posted on, or information or opinions expressed in bulletin boards, chat rooms, or other forums, conducted on this site ("Forums"). You shall not submit or otherwise publish through such Forums any content which:
- libels, defames, invades privacy, or is obscene, pornographic, abusive, or threatening;
- infringes any intellectual property or other right of any entity or person, including, but not limited to violating anyone's copyrights or trademarks;
- violates any law;
- advocates illegal activity;
- advertises or otherwise solicits funds or is a solicitation for goods or services; (collectively "Non-Approved Material").
By uploading materials to any Stan Lee Media Forum or by submitting any materials to us, you automatically grant (or warrant that the owner of such rights has expressly granted) us a perpetual, royalty free, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology now known or later developed throughout the universe.
In addition, you warrant that so-called "moral rights" in those materials have been waived.
You agree to indemnify Stan Lee Media and its officers, directors, employees, agents, distributors and affiliates from and against any and all third party claims, demands, liabilities, costs, or expenses, including reasonable attorney fees, resulting from your breach of any of the foregoing agreements, representations, and warranties.
DISCLAIMER
The materials in Stan Lee Media web sites are provided "as is" and without warranties of any kind either express or implied. To the fullest extent permissible pursuant to applicable law, Stan Lee Media disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.
Stan Lee Media does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that Stan Lee Media's web sites or the server that makes them available are free of viruses or other harmful components. Stan Lee Media does not warrant or make any representations regarding the use or the results of the use of the materials in Stan Lee Media's web sites in terms of their correctness, accuracy, reliability, or otherwise.
You (and not Stan Lee Media) assume the entire cost of all necessary servicing, repair or correction. Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you. TERMINATION
These terms are effective until terminated by either party. You may terminate these terms at any time by destroying all materials obtained from any and all Stan Lee Media site(s) and all related documentation, copies, and installations thereof, whether made under the terms of this Terms of Use Agreement or otherwise. These terms will terminate immediately without notice from Stan Lee Media if in Stan Lee Media's sole discretion you fail to comply with any term or provision of these terms.
Upon termination, you must destroy all materials obtained from this site and any and all other associated site(s) and all copies thereof, whether made under the terms of these terms or otherwise.
JURISDICTIONAL ISSUES
Unless otherwise specified, the materials in Stan Lee Media web sites are presented solely for the purpose of entertainment and promoting programs, films and other products available in the United States, its territories, possessions, and protectorates. This site is controlled and operated by Stan Lee Media from its offices within the State of California, United States of America. Stan Lee Media makes no representation that materials in Stan Lee Media's web sites are appropriate or available for use in other locations.
Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
This agreement shall be governed by, construed and enforced in accordance with the laws of the State of California, as it is applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or Stan Lee Media bring to enforce this agreement or, in connection with, any matters related to this site shall be brought only in either the state or federal courts located in Los Angeles County, California, and you expressly consent to the jurisdiction of said courts.
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by Stan Lee Media.
YOUR ACCEPTANCE OF THESE TERMS
By using this site, you signify your assent to the Stan Lee Media Terms of Use Agreement, including its Privacy Policy. If you do not agree to this Terms of Use Agreement, please do not use our sites. Your continued use of the Stan Lee Media's sites following the posting of changes to these terms will mean you accept those changes.
